Tax and Regulate Marijuana

A look at some of the reasons why the United States should consider taxing and regulating marijuana for responsible adult use.

The opinions expressed below by our viewers and posters do not necessarily represent the opinions of the Marijuana Policy Project. These views are those of the individual authors alone. MPP does not condone or support the illegal use of marijuana. We do encourage open and frank discussion, but if a comment has been posted that is in some way significantly inappropriate, please e-mail us at socialnetwork@mpp.org to report it. Thank you, and we're looking forward to what you think!

Ya know….I just dont understand the logic here…AT ALL! All of these different points being made to support the legalization of marijuana are COMPLETELY legit. So here is my question; Why is our government brushing this issue off of its shoulders and completely ignoring the large percentage of Americans who are behind this notion? The portion of people who don’t support it are the members of the unfortunate generation that was fed lies by the government and was unwilling to give it a second thought. In a time like this, we need to stop putting thousands of non-violent Americans behind bars for indulging (or medicating) in an activity that should be in the hands of the individual. We need to take the revenue from the tax placed on the herb and put it in to schools, rehab, productive things and so on and so forth. As previously stated, I see absolutely no logic in what our government is doing. However, if there were any valid reasons for their activities, they, the gov, should at least try to rationally explain why they are doing what they do, instead of beating around the bush.

Here is my point. If a responsible adult can come home from a long day of work and have a drink to relieve some stress, why shouldn’t another responsible adult be able to go home and light a joint without having to worry about being arrested.

If there is a logic for this outdated law, please, enlighten me somebody.

Dear Thiels and everyone else with this great question,
If you really want to know why the Republicans are soo against the legalization of MJ then you need to know why it was made illegal back in the 30s. First, many of you know that Republicans have been the most racist party in politics and they are the most Christian based party…so with that, back to my point. Many of the white children were hearing about this cigarette that would make you hallucinate that only the blacks and a few white people had. Since everyone know hows alcohol and tobacco spreads at the age of 16 to 18 then you can imagine how easy it spread to white kids for their personal usage. Then all the parents, who more than likely were a bunch of “god fearing people” who thought for one that blacks were bad in the first place, probably caught wind that their children were playing with black people, daughters may have been engaging in “devils work” by maybe having sexual relations with blacks….which back in the 30s was like murder now….so all the pissed off people started writing their congressmen and whoever represented them back then, and just the opposite of todays truth about pot, the parents started making up LIES to make their children not want to use pot. Lord have mercy if people enjoy life. But now, since people are realizing Christian ways have killed more people than communism and tobacco/alcohol combined…the truth is coming out…and since we really dont have a problem with race any more, parents (probably most use pot anyway) are no longer making up lies and endorsing DARE. My question is with this history lesson, is why can a black president, who made is career as being the first black president, be against something that was almost the main point in the 40s and 50s for segragation and such? I think its time to stop oppressing people for their personal beliefs…whether its gay rights, smoking pot, or even picking your crack in public…although i will end this with ” dont smoke crack”

  3. JJ

oh yeah, if you dont think this comment is true (it came from a 90 year old man in a nursing home I interviewed about a year ago) then why is it that only a few Democrats dont want pot legal and ALL Republicans shoot down anything that even says POT on the bill???????? KINDA FISHY ……..dam racism……

How do lawmakers know what to vote on? What do they really care about? The truth is they don’t care. Most will do what the people want of them, we just have to let them know. Call them, email, go to there office and let them know how you feel.

They will keep track of what side people are on by there phone calls and emails. As long as we keep on them, they will vote the way we want.

If you are reading this you can help. Take some time to send a email to your lawmaker. Then give them a call, you wont have to talk to them, just leave a message. Tell them this is a make or break issue for you and your VOTE depends on there vote.

Next go tell people that you know all about our effort. Have them contact law makers as well. If they keep hearing from us and new people, every time they look in there inbox, they will have to act.

Hi all, HR 5842 according to my MI representative Debbie Stabenow, has already DIED in subcommittee! Forget HR 5843. At least she answered my question about REMOVING MJ from Schedule 1 Status.

May I suggest that nothing happens for one particular reason? There are many reasons why MJ is classified as Schedule 1. In the documentary “Grass’ they claim it was the agenda of controlling Mexicans in the beginning, here we have racism. I read it was the Logging industry who lobbied for illegalization, because I believe they knew it would be a threat to their livelihood, because until then SO many things were made of Cannabis fiber and of the oil. I hear now its BIG ALCOHOL lobbing to keep it illegal. They know it would be the recreational drug of choice and that scares them, again livelihood. Pharmacy Lobbies too they would lose billions on some of the garbage they come up with to try to relieve symptoms of many of the illnesses that are easily taken care of by Marijuana! $$$ again! I heard even Big Tobacco wants it to stay illegal. I also heard that they have refitted factories ready to pump out packs of “Panama Reds”. I don’t know.
The studies have been done and suppressed by numerous administrations, the biggest reason it’s still unduly lumped together with Heroin
I do know that I am applying for a Medical MJ License in my state and so far NO one has called me back- I found out about the http://www.thc-foundation.com and they set up appointments with Licensed Doctors to help in getting a License. They’re based in Oregon and do “Rounds” throughout the Medical MJ states. RIGHT NOW – and tomorrow they are in MI – only – That really got to me that I had to hear this at the last minute. I am very sick and I shouldn’t be denied information that can help me. I never heard one thing from the MPP on this and now I realize truly what the mission statement means. It means to me that the main interest is strictly governmental lobbying and that’s fine. That’s their way. But I must say that I will also join Norml now because their name is all over the “how to and where to find a doctor who’s willing to help” issue, which to me IS VERY IMPORTANT!
ALSO, ISN’T CIVIL DISOBIDIENCE WHAT REALLY STARTED AMERICA? I THINK I WILL FIND A “SMOKE –IN” AND ATTEND ALSO.
MPP – THE HR 5842 IS DEAD- IT’S A MOOT POINT AND THE LINK IS NOW USLESS- THANKS FOR NOT KEEPING UP ON THAT ONE. IT’S INCREDIBLY IMPORTANT. BTW – I’M NOT YELLING – MY PC JUST FLIPPED OUT AND WON’T LET ME WRITE IN ANYTHING BUT CAPS. I NEED TO RESTART.
    HAVE A NICE DAY ALL.

  6. matt

Ya there is no true, logical reasoning to keep cannabis illegal. The public has been misinformed and buys into anti-legalization propaganda that is not true. Which is why democracy fails with an ignorant majority. Inform as much people as you can on the issue, this is all we can do. Especially the people in the government, even if you didn’t vote for them.

  7. CM

    JJ,

let’s go ahead and make dicisions not based on one man’s opinion but on research that you have done that makes sense. I don’t know you, but you sound like a parinoid liberal in your comments. I hope you’re not a parinoid liberal, we don’t need more of those kind of people running the show. Now, go smoke a joint and relax a little.

All they hear is the sound of money, IMO. I believe if we all began sending a check, each month, with our voluntary marijuana personal use tax of $4.20 per ounce, one to our state and another to our federal representatives. I believe they may begin to hear us.

I propose all who can afford to, to send a check to your state and US representative, make them payable to the state and US treasury respective, and in the memo, write, “Voluntary Cannabis Consumption Tax”

Would the President laugh if we set up a PayPal drive for a Voluntary Marijuana Tax to be paid out when all federal restrictions are removed. Just let the balance of the account speak for us.

Just a notion, a reverse Tea Party of sorts

  9. JJ

Hey CM, na…im not a liberal…i think…i dont know what the parties mean…and really over the last 3 years…i dont think politicians know what party they are in…but anyways, I am a very laxed person who just wants to get this stuff legal…I have carpol tunnel in BOTH wrists, 4 blown discs (possible another 4 more) and I have had 3 knee surgeries. Also, thanks to my dad, I will have Muscular Dystrophy b4 I turn 36…I may be laxed but with those serious health problems, I will do anything to get this legal…i find it shitty that I put my girlfriend and her daughter at risk because I dont want to get addicted to the percocets and the vicodines all over again, so i smoke my pot…illegaly…and look through the window in the living room every time i hear a car door slam thinking its the po po…so…maybe I am a paranoid…but I have a lot to lose..

  10. joshua

This video expresses many good points…..i think it needs to add the facts of how many jobs could be created to support the cash crops……all the truck drivers that will have more jobs…..if you place crops in specific states, those states would then gain tourists and bring money back to bad economic areas….Michigan for example could use some tourists….usa would gain a new meaning for being a free country……it would bring new meaning to FREEDOM

  11. Joey

I never heard of someone needing rehab for marijuana! I think tax revenue from “the weed” should be used to help alcohol addiction. Stop the violence. The only reason anyone ever had went to rehab for smokin the pot was because they had “that choice” or “jail”.

  12. Terri

I am stunned by the way this is all playing out, medical marijuana has really become a key player in the medical field. I am a Pharmacy Technician by trade but have been in the health field in many compacities. I have really been thankful for the progress that we(the patients) have made in fighting for the choice to use herbal medications. Marijuana is a natural substance grown in the ground like other produce, it doesn’t have to be processed or contaminated by harsh chemicals like cocaine and other drugs that can be lethal in overconsumption. I have never heard of a person overdosing on it, robbing banks, stealing from family, or any of the other affects that have been documented in other (Narcotic)substances. I would like them to first stop calling it a Narcotic because it is an Herb and should be appreciated as such. I will be glad when it is recognized a true medication and dispensed as such. That way the government can stop double dipping-first they charge us to become legal consumers, then they tax us, then find a reason to raid and arrest those dispensaries, So they are playing a DIRTY win win game.

  13. NEW YORK NEED A CHANGE FOR MEDICAL USE FOR MARIJUANA LIKE CALIFORNIA LIKE OTHER STATES HAVE MEDICAL USE . THE DRUG COMPANIES ARE REAPING BILLIONS OF DOLLARS OFF THE CONSUMERS WITH MEDICATIONS THEY MANUFACTURE USED FOR PAIN OR MENTAL ILLNESS THAT HAS SIDE EFFECTS AS A MEDICATION I WAS PRESCRIBED WITH THAT GAVE ME DIABETES . NEW YORK RESIDENTS NEEDS YOUR SUPPORT FOR OTHER RESIDENTS TO SEND ALBANY NEW YORK LAW MAKERS A REQUEST TO PASS A BILL FOR MEDICAL USE OF MARIJUANA FOR NEW YORK !!! FROM NUNZIO BAGLIERE

The United States of America’s Government has utterly failed us all, what good is a democratic government if it doesn’t follow democracy? The numbers of people shouting out for the legalization of marijuana cannot and should not be ignored any longer! If recent polls show an unwavering 40%,41% and 40% of Americans wanting to legalize it, how can the government keep ignoring the cries for help? What is our governments definition of majority? Lets look at numbers:

Population of America as of 2008 census :

    303,824,640

Poll as of 2009 an estimated 41% of Americans feel that legalization of marijuana is OK :

    41% of 303,824,640 :

    an Estimated 124,568,103.

Does anyone see the problem here?

American history has taught us that as Americans we ALL have the RIGHT, and DUTY to cry out and question our government! How much longer will we Americans Stand back and let people WE voted into office IGNORE US! We voted these people into power because they made a promise to Us, a promise to do everything in there power to make sure that our voices (for each respective state) are heard around the country and are EQUALLY and FAIRLY Represented.

Do these numbers represent that promise?

My Name is Stephen Harris, i am 18 years old, and according to the united states government?

  15. legalize marijuana

    hello to everyone.
I dont understand why congress cant legalize marijuana.. so many of us have spoken and discuss with our friends and family members.. but we need to take a step and let congress and our state representatives know. i believe that they dont want marijuana to be legalized because they will lose alot of sales from alcohol and cigarettes.. god created everything on earth for a reason. we live in a nation of nonsense.

  16. tony

all the comments are so true.we must have the biggest idiots in congress anyone could have.they can’t feed their lies to me about marijuana because i’v done both (alcohol and marijuana) and alcohol leads to nothing but trouble, trouble, trouble.on the other hand i’v never been in trouble with marijuana before.never ever, ever!!!!!!and if i did it would be just because a bunch of idiots continue to make it illegal.legalize it or not i’ll never stop smoking it!!!!!!!!!!!!

  17. tony

remember when pot was legal but alcohol wasn’t? then they made pot illegal them made alcohol legal again? well thats where the government screwed up!!!!!!!!!!! i guess my point is that they can’t ever get anything right!!!!!!!!

  18. TerryO.

I may be preaching to the choir here but if everyone who supported the legalization of marijuana would register to vote and let their voices be heard, then we would see change.I’m so proud to see how the internet has become such a soap box for so many supporter’s of marijuana reform and I know that the government is starting to see that we aren’t going away and our message is going to get louder and louder and as time goes by, I see that we are gathering more and more support from the main stream media as well as from politician’s and several of the nation’s top economist.I’m praying hard for all the efforts in California that succeeded in 1996,to do the same for the full legalization of marijuana in the near future. If this initative passes,I’m curious to see just how the federal government will respond.I pray that if President Obama chooses to unleash the pot gestapo/DEA on all those involved in the cultivation, distribution as well as the taxation of legal marijuana in California. Thus totally ignoring the fact that it will be the will of the people FOR IT TO BE LEGAL! That the public outrage will force this administration to back off and let California show the rest of the country that legalizing marijuana is the only logical conclusion to this issue.

  19. tony

look at it this way, alcolhol witch is by the way a drug is legal and has no medical bennefits to ill people so why can’t marijuana be legal knowing it helps sick and dying people?????????????? thats about as unfair as you can get!!!!!!

  20. Yea I am so frustrated with anticipation as to when this shits gonna be decriminalized atleast here in oklahoma its horribly corrupt with the law enforcements. I sent a few emails to my congressmen and he replied each time saying thanks for the email i will mention it to my colleagues… When does anyone think things will start churning?

  21. Patrick

No taxes and no regulation. Are you guys fuckin’ nuts? If you love the State that kinda power, watch out. Man you guys are naive.

  22. Eric

Shut up patrick. This is a great idea and I cant see any reason not to. The benefits far outweight and consquences people think may come about.

  23. charity

I think the only way cannabis will be legalized is if all of the people who smoke it stand up and say “I SMOKE WEED!” Think about it. I believe that a lot of the people that protest against it, actually smoke it, but are so afraid of the potential legal ramifications that they don’t dare stand up and speak out for it. And what about just Joe Blow on the street? Obviously people are smoking it, but do you EVER hear anyone say, I smoke it because I like it? Hell no! People don’t dare say that because of the risk of being arrested. It’s like a huge Catch-22. “I smoke it, but I can’t say I smoke it, so I say I’m against it, so people don’t think I’m smoking it, so I can move forward to get legislation passed and then I can smoke it all I want!” Get it??

  24. freddy

make money off something that u can make money off of and it wasnt before so it brings more money inn and you have happy citizens

  25. Meg

The ONLY reason pot is illegal is so politicians can continue to “own” us. Ever hear of any car accidents being caused just because of marijuana…didn’t think so…that is impossible! Liquor became legal again because what else would politicians use? If they all just fired up a big joint, they’d be calmer & not always fighting! Pot just relaxes a person…it CAN’T make anyone go crazy, unlike alcohol. If it’s legalized kids probly won’t want to smoke it anyway…that was half the fun in high school…pullin’ it over on the “adults”!

  26. john

I HAVE SEVERAL PROBLEMS WITH MY BACK,SPINAL STEINOIS,TEAR L5, S1 BROAD BASED DISC BULGE AT L4 L5 ARTHERITIS IN MY FARCETJOINTS.WELL I JUST HAPPEN TO BE ALERGIC TO ALOT OF THE ANTI INFLAMATORY MEDS,FROM WHAT I HAVE READ AND UNDER ABOUT THE USE OF MEDICAL MARIUJUANA MEDIDICAL BENIFITS IS IT VERY EFFECTIVE FOR THE INFLAMATORY THAT I AM SUFFERING WITH I WOULD LIKE TO TRY THE MARIUJUANNA IF IT HELPS IT WILL BE A BLESING FOR ME.AND IT WOULD HELP ME STOP TAKING ADDICTIVE NARCOTICS TO EASE THE PAIN.PAIN ALMOST RULES MY LIFE BUT I KEEP GOING TO TO FINISH STRONG EVERYDAY.

  27. Ramsey

WHY WHY WHY WHY…..this is the word we use when it comes to legalazation of marijuana… 1st of all cigarrettes kill nun stop every single day of the year, yet u could go to a store and buy it ,,, but the facts are nuts when u look at them head on.. our govt.. knows cigg..or alcohol sales will go down if weed is legalized.. but wat they dont know is they can make alot of $ by taxing.. or they do know it yet they keep hiding something behind the door, to the real reason why there not legalizing it. Like come on they seen our videos they read our blogs.. they see the facts, but still they turn there heads away from the facts____ BUT WHY ?_____ Intresting no ?

  28. JP

I have never smoked weed, but I do drink alcohol. I am a Libertarian, and I am totally against a ‘nanny’ state. So, I support your right to smoke it as long as it doesn’t affect me.

Here’s a question for you. Why wouldn’t everyone grow their own instead of buying it at the store? Wouldn’t that defeat the whole tax revenue side of the argument? Or would you have to consume it in a ‘weed’ bar?

In my opinion, I think we should legalize it, but allow employers to discriminate against workers who use it. I personally think it does affect brain function, but I don’t care if you smoke it till your lungs bleed – just as long as I don’t have to pay your medical bills. (I feel the same way about alcohol.)

  29. MIKE STROUP

War enforced prohibition is a cruel and arbitrary attempt by very dangerous people to wrongfully control the God-given freedom and liberty of all others. The fact that laws continue to exist against behavior that does not violate the rightful liberties and freedoms of others, is a sad testament to the lack of freedom loving American patriots in this country today. Why people continue to allow themselves to be enslaved is beyond me.

  30. Matt

I am sure others are thinking it, but I do not know why others are not saying it so I will have to…

The statistics of those would not mind marijuana being legalized is over 40%, and that is only those that will admit their usage on a survey! I do not know who they polled, but I know a lot of my friends would be too afraid to defend their right to smoke marijuana safely and without government persecution if there was even the slightest possibility of being identified (IP Routing, Fingerprinting, Hand-writing analysis… ok, I know it is kind of silly but have you seen some of the court penalties?).

And for my point…Now keep in mind this is a long shot, but well worth the effort. We are approaching a census year (just shy of 300 days!) and now would be our chance to find out way more accurately just how many of us are out there. If we can just get a one line, “Do you support the legalization and taxation of marijuana?” with a yes/no/undecided/would prefer not to say, the benefits would be numerous. That data will be compiled and broken down by geographic location, age, sex, nationality, you name it! With the results out there for everyone to see, including those that represent us in office, it would be harder to ignore the truth. Some elected officials might even pick up a few new policies to try to sway our votes. ;)

Listen, we know that the numbers are going to be high and well rounded because the positive benefits of marijuana does not discriminate. Also, the question would be of policy and not of actual usage so we are more likely to get more truthful responses. Speak loud and clear, “PUT A MARIJUANA POLICY QUESTION ON THE CENSUS AND LET THE PEOPLE DECIDE!”

  31. Matt

Unfortunately I just found out the 2010 Census will be a short 10 minute bare-bones type ordeal, just asking for your gender, age, race, ethnicity, relationship and whether you own or rent your home, so it just meets the legal requirement to find out how many people are in a given area for the purpose of state funding and to figure out how many representatives each state gets. Fortunately there is another survey sent about every year so we are more likely to get what we want if we just keep at it! I believe they are still a part of the Census Bureau but they are called the American Community Survey. Unfortunately they only survey a sample size of the population like most surveys (though 2.5% of the US population is still quite large) and some cities like mine (Syracuse, NY) are not included even though it seems like we should because we are Upstate NY’s central hub!

Personally I think putting public policy questions on the Census would be Democracy done right. Right now I would settle for just getting this one on one of the forms. Help the cause a voice your opinion at http://www.Census.gov

  32. Anonymous

Sorry, but the idea that all Republicans are against legalization is a LIE.

I am a moderate/conservative and totally favor legalization of marijuana.

If Ron Paul was elected instead of McCain and Obama for the Presidential Election, it would be legal already.

It is illegal due to outside interests beyond the citizen interests of America (corporate interests). A bunch of stoner groups are not together like a timber products company such as New Page or Weyerhaeuser. Oh and pharmaceutical companies also have some very very powerful lobbyists.

  33. jimbo,So.Jersry

Another victim of the American Governments war against the people. Charlie Lynch did absolutely nothing wrong ,as far as many of us Americans are concerned. It’s a shame they are not nominating judge Wu for the supreme court, for I feel he made every effort to spare Charlie the pain and suffering of incarceration. How can we possibly focus our efforts to bring logic and scientific evidence out so all the people can see the crimes being committed not only in this country, but around the world. Will America ever again be a free country.

  34. FRANKLY

People the Pharmaceutical Companies/Corps. are the main reason that
Marijuana has not been legalized. They would lose trillions of dollars of
profits on their manufactured drugs that have side effects worse than the ailment it is prescribed to treat.
When the Feds, DEA, ATF and Congress can come up with a plan to legalize- that would not interfer with big drug manufacturers- then it has a chance to be legalized. Take the Tobacco Industry for example-they have killed millions with cancer and other deadly ailments but they are still selling cigarettes because of Govt regs and the Govt makes big $ too.
Also because of their power and size. POT is less harmful than Legally Prescribed Drugs, Alcohol and Tobacco combined. There are more murders and robberies commited by users and for Prescription Drugs than Pot.

  35. please tax and regulate marijuana,it will help the economy and make it less available to kids, plus put it the hands of people that need it. thank you

  36. A Republican

I’m a republican, christian, rush listening, American and I support MPP & NORML for what they are trying to do. I beilieve Marijuana should legalized & taxed. It’s a lot safer then Alcohol, tobacco or any psychological medication. So people like JJ can stop making grand sweeping generalizations about my political party, and sterotyping all Republicans. Anyone who supports MJ should leave the politics out of it, there will always be extremist in both parties, but when it comes to MJ there’s the facts and its only by the facts that change will happen. The Govt. is hungry right now for new tax revenue and this is going to give them an easy method.

  37. Me

They need to legalize it! First of all the government will be making money and we will be enjoying all the mj, besides were just going to keep smoking street weed until they do. OBAMA!! LEGALIZE!!!

  38. I quit smoking pot in 1991 , when I got married. It was my brides request, we devorced in 1997, I tried too quit smoking tabacco this year, Pot helped, I went 9weeks without a cigarette. I found a cigerette pack in the work locker room with a bud of pot as big as a ones thumb in it, took it home and used it too get 4 of the 9 weeks away from tabacco.Puff here, doobie in hand too deal with that issue, unlit. Got busted because of my niebors barking dog: on a friday holiday,( barking dog issue and uncomunicative niebor) I had a cuncussion 2 years ago and lost my sense of smell, ( And 2000 in medical bills. ) So I didnt know the officer could smell it, I was polite and cooperative.I of course plead guilty. 500 dollars and 24 hours of sweat shop garbage sifting, I am smoking cigerettes again from the fear and stress of court. All this because of a bud i found,1 little bud!!!! While I was trying too stop an addiction that will kill me. Please, forward this I have an IQ over 125, I build life saving firetrucks and Never, I mean ever go too work on pot.Never! Risk harm or death with a 3000 pound forklift of a fellow employee: NOT! Even 10-20 years ago I wouldn’t do that! One must have ethics.I just wanted to quit cigarettes and it was working. President Obama I sincerely support, I gave him about 200 votes with that support. Maybe he should rethink these b/s pot laws, and save my taxes and yours, and regulate as well as capitalize in the probable revenue! As well as taking this herb out of the hands of greedy hords of evil men and putting it the hands of American farmers, as a legitamiate income crop. Nicotine patches affect my skin, rash and some bleeding. Pills have side effects like sleeplessness and nausia.last; Shayman have used Marajuana for as long as mankind has been a creature of knowledge. For spiritual as well as medical use.And FYI, studies show it is a safe herb! Get out of the 40’s, please!

  39. Kam'ron

I think marijuana should be legalized. why? Marijuana comes straight from the earth, not like cocaine or meth, etc. which is made by man. You’ve always known cigarettes can give you cancer, you’ve never heard of weed giving you cancer. I feel you should atleast be able to smoke freely within your own home/environment.

  40. Cliff

Yes the Creators gift cannabis should be legal. Taxed and regulated by the evil scums who have caused so much pain and suffering with their war on freedom ( drugs), hell no. Legal and free for all to use as they please. Banishment to everyone who has participated in the war on freedom.

  41. To Uncle scam

Fine! if you don’t want to legalize it then we’ll just support the Mexican’s. And we’ll keep growing illegaly in the mountains of California and elsewhere. You started the war and we want to finish it. Illegal only makes it available to the younger people aswell as all others it’s more of an open market. We’ll keep having the grow homes and nothing will ever change makes perfect sense huh?
